September 4, 2007 Meeting Minutes

At 7:04 PM Mayor Stan Wielinski called the meeting to order.  

ROLL CALL:  Herb Little, Maridee Curry, Ryan Grant, Joe Wielinski, Bill May, and Debby Curry were present.  Also present were the following:  Administrator Dennis Recker, Solicitor Phil Davis, Police Chief Ed Kaplan, Clerk Susan Miller, Veronica Judy Kethel, Barbara Knisely , Marvene Farthing, Joshua Peters, Pat and Frank McDonald, Michelle Tippie, Larry Tippie, Robert Keogh, Rob and Kathy Casaletta, Jeff Yoder, Kim Vicay, and Jim Grove.  

Motion by Debby Curry, seconded by Ryan Grant to approve the minutes of the August 21, 2007 Council Meeting and the August 26, 2007 Special Council Meeting.  6 ayes  

Motion by Debby Curry, seconded by Maridee Curry to approve the bills dated September 4, 2007 totaling $31,360.23.  6 ayes  

Motion by Bill May, seconded by Debby Curry to amend the current zoning code to require a fee free permit, issued by the Building and Zoning Office for  portable storage units.  The permits will be for 30 days with the ability to renew the permit twice for a total of 90 days.  6 ayes  

Motion by Bill May, seconded by Debby Curry to amend the current zoning code to allow existing gravel driveways to be replenished or repaired with additional gravel (1258.03) and the installation of gravel pads in the rear yard for storage of recreational vehicles (1258.05).  The requirement remains as far as size – 1 foot larger on all four sides of the vehicle to allow for easy weed and grass control around the vehicle.  The screening requirement around 3 sides of the vehicle also remains.  5 ayes  1 nay Joe Wielinski  

Motion by Bill May, seconded by Debby Curry to amend the current zoning code concerning the loading and unloading option currently established in Section 1258.05 (A e 1), to remove the words “within any consecutive seven day period”, thus allowing loading and unloading not to exceed a 24 hour period.  6 ayes  

Motion by Bill May, seconded by Debby Curry to amend the current zoning code concerning temporary signs Section 1259.07(F) to change the language to read:  “…other requirements of this zoning code are complied with and provided a permit not to exceed thirty (30) days is obtained.  A thirty (30) day permit can be issued for any one business or location not to exceed a total of 4 permits in a calendar year.  6 ayes  

Motion by Bill May, seconded by Debby Curry to enter into a contract with the Walter Drane Company concerning updates to the Codified Ordinances for the 2007 code updates in the approximate amount of $4,200.00.  This would include all update to date and a copy of the entire Codified Ordinances on a disk so that the Village can place this information on the web site.  6 ayes  

Motion by Debby Curry, seconded by Joe Wielinski to proceed with the interviews and recommendation of an agency to redesign the Village website and a brochure not to exceed the amount of  $12,000.00.  6 ayes  

Motion by Debby Curry, seconded by Ryan Grant to authorize the Solicitor to prepare legislation authorizing the Village Administrator to prepare and submit an application to participate in the Ohio Public Works Commission State Capital Improvement and/or Local Government Transportation Improvement Program and designating the Administrator as the signatory representative for the Village of Whitehouse on any and all contracts with full power and authority to execute same, and declaring an emergency.  6 ayes

At 7:03 Mayor Stan Wielinski called the meeting to order.

Motion by Debby Curry, seconded by Maridee Curry to approve the minutes of the September 4, 2007 meeting. 6 ayes  

Motion by Debby Curry, seconded by Ryan Grant to approve the bills totaling $147,594.50 and the addendum bills totaling $522.87 both dated September 18, 2007 and the August Financial Statement.  6 ayes  

Motion by Debby Curry, seconded by Joe Wielinski  to grant the Cherry Festival Committee requests for:

            -use of the Village of Whitehouse Park Friday, June 14, 2008 from 4:00 PM – Midnight and Saturday, June 15, 2008 from 9:00 AM -  Midnight,

            -a liquor permit for both dates for the beer  tent,

            -permission to close Indianapolis Avenue for the car show on Saturday, June 15, 2008 from 9:00 AM – 5:00 PM ,

            -permission to close down Providence Street on Saturday, June 15, 2008 at noon for the Cherry Festival Parade.

Motion by Ryan Grant, seconded by Maridee Curry to change the Anthony Wayne High School Homecoming Parade route, to be held on September 28, 2007 at 5:30 PM, so that it is closer to the high school, using Finzel, Rupp, Cemetery, and Grover Streets.  6 ayes  

Motion by Debby Curry, seconded by Ryan Grant to accept Resolution 41-2007 accepting the amounts and rates as determined by the budget commission and authorizing the necessary tax levies and certifying them to the county auditor.  The amount approved by the budget commission inside the 10 mill limitation from the general fund is $350,000.00.  6 ayes  

Motion by Maridee Curry, seconded by Herb Little to appoint Ryan Grant as the Council Member on the Downtown Revitalization steering committee.  5 ayes, 1 abstain Ryan Grant  

Upon the recommendation of the Economic Development Committee, motion by Ryan Grant, seconded by Debby Curry to authorize $12,000.00 towards the development of a Village website and pamphlet.  6 ayes  

Upon the recommendation of the Economic Development Committee, motion by Ryan Grant, seconded by Joe Wielinski to authorize $1,659.00 for the Village’s 2008 LCIC membership fee.   Council vote 3 ayes 3 nays.   Mayor Wielinski voted aye to break the tie vote making the final vote 4 ayes, 3 nays.  

Upon the recommendation of the Public Services Committee, motion by Maridee Curry, seconded by Debby Curry to accept as previously authorized on August 21,2007 , Resolution 43-2007 authorizing the Administrator to enter into a contract with Poggemeyer Design Group for plan and design services on construction of a water service line to Noward Road from the Village of Whitehouse , Lucas County, Ohio, at its first reading and declaring an emergency.  6 ayes  

Motion by Debby Curry, seconded by Bill May to suspend the rules and to have the second and third reading of Resolution 43-2007 by title only and declaring an emergency.  6 ayes

Motion by Debby Curry, seconded by Ryan Grant to accept as previously authorized, Resolution 40-2007 authorizing the Village Administrator and the Finance Director to enter into an investment management agreement of limited duration and scope with SJS Investment Consulting, Inc., Sylvania , Ohio , for the amount of $1,500.00 per quarter at its first reading and declaring an emergency.  6 ayes  

Motion by Debby Curry, seconded by Ryan Grant to suspend the rules and to have the second and third reading of Resolution 40-2007 by title only and declaring an emergency.  6 ayes

Motion by Debby Curry, seconded by Ryan Grant to authorize the Solicitor to prepare legislation authorizing the interim Finance Director of the Village of Whitehouse , Lucas County, Ohio, to transfer the following funds for Village accounting purposes:

            -$183,584.57 from Income Tax B to the General Fund

            -$26,422.00 from Income Tax A to the Bond Retirement Fire Truck

            -$63,900.00 from Income Tax A to the OWDA Fund

            -$216,000.00 from Income Tax A to the St. Louis, Providence , Temperance Street CP

            -$183,000.00 from Income Tax A to the Toledo, Sherman, Cable CP

Formal verification of said transfer and declaring an emergency.  6 ayes  

Motion by Ryan Grant, seconded by Debby Curry to accept Resolution 42-2007 authorizing the interim Finance Director of the Village of Whitehouse, Lucas County, Ohio to transfer certain funds for Village accounting purposes; Formal verification of said transfer at it s first reading and declaring an emergency.  6 ayes

Motion by Maridee Curry, seconded by Bill May to accept as previously authorized on September 4, 2007, Ordinance 21-2007 prohibiting parking upon the west side of Providence Street in the Village of Whitehouse, Lucas County, Ohio from the intersection of Nona France Park entrance to the intersection of Stiles Road, inclusion of said prohibition in Whitehouse Village Code Section 351.03, at its first reading and declaring and emergency.  6 ayes
