Council Meeting - March 6, 2007  

At 7:00 PM Mayor Stan Wielinski called the meeting to order.  

ROLL CALL:  Ryan Grant, Joe Wielinski, Bill May, Debby Curry, Herb Little, and Maridee Curry were present.  Also present were the following:  Administrator Dennis Recker, Solicitor Phil Davis, Finance Director Michael Nolte, Fire Chief Daryl McNutt, Police Chief Ed Kaplan, Clerk Susan Miller, Bob Casaletta, Jim Farthing, Brad and Laura Hibbard, Phil Whaley, Bud Bauman, Tom and Kathy Spears, Jim Miller, and Deb McNutt.  

Motion by Debby Curry seconded by Maridee Curry to approve the minutes of the February 20, 2007 meeting and the minutes of the Special Council Meeting of February 27, 2007 .  6 ayes  

Motion by Debby Curry seconded by Maridee Curry to approve the bills totaling $20,437.13 and the addendum bills totaling $36,221.66 dated March 6, 2007 .  6 ayes  

Dr. John Granger, Anthony Wayne Schools Superintendent presented Fire Chief Daryl McNutt with an award for High Achievement.  

Upon the recommendation of the Personnel and Safety Services Committee, motion by Joe Wielinski seconded by Debby Curry to accept the Village’s Comprehensive Safety Policy and Plan.  6 ayes  

Upon the recommendation of the Franchise, Lands, and Buildings Committee, motion by Ryan Grant, seconded by Debby Curry to declare the 6.3 acres of land owned by the Village on Logan Street as surplus property.  6 ayes  

Upon the recommendation of the Finance Committee, motion by Debby Curry, seconded by Ryan Grant to authorize the Solicitor to prepare legislation establishing a Contractor Registration Program in the Village of Whitehouse .  6 ayes  

Upon the recommendation of the Finance Committee, motion by Debby Curry, seconded by Bill May to authorize the Solicitor to prepare legislation amending the Village’s Building and Zoning Schedule of Rates and Fees.  5 ayes, 1 nay Maridee Curry  

Upon the recommendation of the Finance Committee, motion by Debby Curry, seconded by Ryan Grant to authorize the Solicitor to prepare legislation initiating a $9.00 per month Refuse Service Fee placed on the monthly water and sewer bill effective May 1, 2007 .  4 ayes, 2 nays Bill May and Maridee Curry  

Upon the recommendation of the Finance Committee, motion by Debby Curry, seconded by Joe Wielinski to authorize the Solicitor to prepare legislation temporarily eliminating the Village tax credit over a two year phase in period retroactive to January 1, 2007 on the following schedule:  

·        Reduce the tax credit to .25% (Funds received in 2008)

·        Reduce tax credit to zero effective January 1, 2008 through December 31, 2012   (Funds received in 2009) (Will remain at 0% for a 5 year period)

·        Phase back tax credit over a two year period to the original .75%. (January 1, 2013 Tax Credit raised to .25%) (January 1, 2014 Tax Credit raised to .75%)

Motion by Debby Curry, seconded by Maridee Curry to accept as previously authorized, Resolution 9-2007  authorizing the Village Administrator to enter into all necessary agreements as the Chief Contracting Officer for the Village of Whitehouse , Lucas County, Ohio with respect to the Ohio Department of Transportation for the improvementof certain roadway intersections at Finzel Road and  State Route 64 and Cemetery Road and  State Route 64 in the Village of Whitehouse , Lucas County, Ohio repealing Resolution 30-2006 at its first reading and declaring an emergency.  6 ayes

Upon the recommendation of the Public Services Committee, motion by Herb Little, seconded by Joe Wielinski to authorize the Solicitor to prepare legislation to enter into a contract with Poggemeyer Design Group for engineering services for improvements and additions to the Public Works Maintenance Facility.  6 ayes  

Upon the Recommendation of the Public Services Committee, motion by Herb Little, seconded by Debby Curry, to authorize the Solicitor to prepare legislation amending section 1258.05(A)(1) of the Whitehouse Village Code of Ordinances declaring an emergency.  6 ayes  

Upon the recommendation of the Public Services Committee, motion by Herb Little, seconded by Bill May, to authorize the Solicitor to prepare legislation amending section 1257.07 of the Whitehouse Village Code of Ordinances and declaring an emergency.  6 ayes  

Upon the recommendation of the Public Services Committee, motion by Herb Little, seconded by Debby Curry, to authorize the Solicitor to prepare legislation for the expenditure of $8,920 to complete the installation of the dump truck  body and related parts for a new dump truck.  6 ayes

Upon the recommendation of the Public Services Committee, motion by Debby Curry, seconded by Bill May to accept Ordinance 2-2007 amending section 1258.05(a)(1) of the Whitehouse Village code of Ordinances at its first reading and declaring an emergency.  6 ayes  

Motion by Debby Curry, seconded by Bill May, to suspend the rules and to have the second and third reading of Ordinance 2-2007 by title only and declaring an emergency.  6 ayes

Motion by Ryan Grant, seconded by Debby Curry, to authorize the Solicitor to prepare legislation indicating the Village of Whitehouse , Lucas County, Ohio, will provide utilities, fire and police protection services to certain property owned by the Board of Education for Anthony Wayne Local School District and Cobra Ventures, LLC, which owners are seeking annexation of said property pursuant to Lucas County annexation petition 07-2 to the Village of Whitehouse , and declaring an emergency.  6 ayes

Upon the recommendation of the Public Services Committee, motion by Herb Little, seconded by Joe Wielinski to authorize the Solicitor to prepare legislation to enter into a contract with Dixon Engineering to assess and make a recommendation to the Village regarding repairs to the water tower at a cost of $1,897.00.  5 ayes  

Upon the recommendation of the Public Services Committee, motion by Herb Little, seconded by Debby Curry, to authorize the Solicitor to prepare legislation to enter into a contract for the emergency repair of the sanitary sewer in front of the Regional Pump Station on Finzel Road at a cost not to exceed $38,000 and declaring an emergency.  5 ayes  

Upon the recommendation of the Public Services Committee, motion by Debby Curry, seconded by Joe Wielinski, to accept as previously authorized on March 6, 2007, Resolution 10-2007 authorizing the Administrator to enter into a contract with Poggemeyer Design Group for construction and design services on a maintenance building for the Village of Whitehouse, Lucas County, Ohio, at its first reading and declaring an emergency.  5 ayes

·        The position of Police Sergeant is being posted internally after some changes to   the job description.

·        The Village received a letter from Waterville Twp. to reconfigure boundaries and discuss the effects of redistribution.

·        Sergeant position will be at no additional cost to the Village

·        Procedure for picking the Citizen’s council

Council Minutes - April 3, 2007

Motion by Debby Curry, seconded by Bill May to approve the bills dated April 3, 2007 and totaling $24, 728.75 and the addendum bills dated April 4, 2007 and totaling $26,548.78.  6 ayes  

The Mayor appointed the following members to the Citizen’s Committee to review Village Operational and Capital needs and to prepare recommendations to the Mayor and Council regarding budget adjustments and revenue enhancement actions:  Jim Farthing, Kenny Ehasz, Vicky Rose, Robert Casaletta, and Veronica Judy Kethel.  

Motion by Debby Curry, seconded by Bill May to authorize the Village Administrator to enter into a contract with Decatur Electronics for the purchase and installation of three video camera recorders not to exceed the amount of  $14,000.  6 ayes  

Motion by Debby Curry, seconded by Ryan Grant to have the motion for the refuse collection fee of $9.00 per month effective June 1, 2007 read in the form of three separate readings.  6 ayes  

Motion by Debby Curry, seconded by Joe Wielinski to place the new zoning and building permit fees schedule back on the order of business as an emergency.  6 ayes  

Upon the recommendation of the Finance Committee, motion by Debby Curry, seconded by Bill May to accept, as previously authorized, Ordinance 6-2007 amending section 1319 – building fees – of the codified Ordinances of the Village of Whitehouse, Lucas County, Ohio, repealing Ordinance No. 14-2005, at its first reading and declaring an emergency.  6 ayes
