January 2, 2008 Meeting Minutes

The meeting was called to order at 7:31 p.m. by Vice-Chairman Robert Peinert.  Board members present were Robert Werner, Leroy Ryerson and Michael Williams.  Also present was Barbara Knisely, Kirby Shuey, Ray Wood, Ruth and Rickie LaPoint, James Stone and Dennis Recker, Village Administrator.   

Motion by Leroy Ryerson, seconded by Robert Werner to accept and approve the Minutes of the December 5, 2007 meeting.  Motion passed by a vote of 4-0.  

Due to the fact that Mayor Angela Kuhn will be appointing and swearing in Mr. Robert Keogh, the fifth member of the Board of Zoning Appeals, at the January 8, 2008, Council Meeting, Mr. Ryerson made a motion to table the organizational meeting and election of officers until after that date.  Mr. Williams seconded the motion, motion passed 4-0.  

Testimony was given by Ray Wood, Agent/Applicant for Whitehouse Square to allow the place-ment of a temporary sales trailer for an additional six (6) month period at the corner of Whitehouse Square Blvd. and Waterville Street.  This Board previously granted a variance for its placement at their June 6, 2007 meeting.  Mr. Wood explained that the developer will be constructing a permanent office structure, but that due to the slow start of this development, that has not been accomplished yet.  Mr. Ryerson made a motion to grant a six month extension (until July 2, 2008) for the placement of this temporary sales trailer.  Motion was seconded by Mr. Williams, motion passed 4-0.  

James Stone then gave sworn testimony concerning his application to allow the placement of a recreational vehicle (32’ camper) next to his garage in the side yard at his residence, contrary to Section 1258.05(A)(1)(e).  Based on the finding of facts that the Applicant has other options for storage of this vehicle (placing it in the rear yard screened from view on three sides or storing it off-premises) a motion was made by Mr. Ryerson and seconded by Michael Williams to deny the request for a variance which would have allowed the placement of the vehicle in the side yard.  Motion passed 4-0.   

Next, Ruth and Rickie LaPoint gave sworn testimony concerning their application for a five (5’) foot variance to the rear and side yard setbacks at their residence located at 6001 Matthew Drive.  The LaPoints would like to construct a detached garage in their rear yard.  Based on the finding of facts, Mr. Williams made a motion to grant the five foot (5’) rear and side yard variances, seconded by Mr. Werner, motion passed 4-0.  

All persons filing appeals were advised that they have the right to appeal the Board of Zoning Appeals decision to the Village Council.  Mr. Stone will be sent a letter advising him of this process.  

With no further business before the Board, Mr. Williams moved to adjourn, seconded by Mr. Werner.  All voted yea and the meeting was adjourned at 8:00 p.m.
